The Law-Nudes-Requests for Nudes
Is it against the law to ask for Nudes?
No. In New Zealand, if someone is sharing (or is threatening to share) nude photos or intimate images of you without your permission, there are a number of laws they might be breaking BUT it is not against the law for someone to ask for nudes.
It is the sharing that is the issue.
Is it against the law to send nudes?
Young people sometimes share nude or nearly nude images, known as sexting. Under New Zealand law, those under 18 who create or share such content may technically be in possession or distribution of objectionable material. Sharing with an underage person could also mean supplying objectionable material to a minor.
On-sharing nude images/videos of anyone under 18 is legally considered distributing child sexual abuse material (CSAM), even if originally shared consensually. Law enforcement focuses on those knowingly creating, possessing, or distributing CSAM and are likely to consider the nature of consensual relationships of people under 18.
